1. Agreement to Terms
These Terms of Service ("Terms") form a binding agreement between you and Digital Products Tech LLC, a Wyoming limited liability company with principal address 30 N Gould St Ste R, Sheridan, WY 82801 ("Company", "we", "us", or "our"). By accessing or using digitalproductsdp.com, you accept and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site.
2. Definitions
"Site" means digitalproductsdp.com and its subdomains. "Content" means all text, graphics, data, charts, scores, software, and design on the Site. "Sentiment Data" means Pulse Scores, theme analyses, trend charts, mention counts, excerpts, and related metrics published on the Site. "User Content" means anything you submit to us, including through forms, email, or other channels. "Services" means the Site, its tools, data features, and email communications we provide.
3. Eligibility
You must be at least 16 years old to use the Site. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" includes that organization.
4. The Services
The Site provides editorial articles and guides about AI tools and software; community sentiment tracking and Pulse Scores; interactive tools including comparisons and calculators; and email newsletters and waitlists. Paid subscriptions may be offered in the future under additional terms presented at the time of purchase. Joining a waitlist is not a purchase and creates no obligation on either side.
5. Sentiment Data
Pulse Scores are computed summaries of aggregated public online discussion collected from public sources such as Hacker News and YouTube. Collection is automated. Classification uses AI models. Scoring follows the method described on our Methodology page.
Sentiment Data has inherent limitations. It samples a subset of public discussion, not all conversation about a product. Platform audiences skew technical. Automated classification has error rates, and individual classifications may be wrong. Products with low mention volume carry wider uncertainty. Weekly snapshots reflect the period measured, not all time.
Sentiment Data represents the tone of public conversation only. It is not a statement of fact about any product or company. It is not a review or rating by us, not an endorsement or criticism, and not advice of any kind.
Companies that believe data about them is inaccurate may contact us through the business feedback page. We review submissions in good faith, but publication, response, and any correction remain at our sole editorial discretion. We may add, change, recompute, or remove Sentiment Data at any time.
6. No Professional Advice
Nothing on the Site is business, financial, investment, legal, tax, or purchasing advice. You should verify anything important independently before making decisions. Any decisions you make in reliance on the Site are at your own risk.
7. License to You
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access the Site for personal and internal business reference. Brief quotation of Content with attribution and a link back to the Site is permitted. Any other reproduction, distribution, or commercial exploitation of Content or Sentiment Data requires our written permission.
8. Intellectual Property
The Site, Content, Pulse Score presentation, compiled datasets, branding, and software are owned by or licensed to the Company and are protected by copyright, trademark, and other intellectual property laws, including database and compilation rights. You may not copy, modify, or create derivative works except as expressly permitted by these Terms.
Third-party product names, logos, and trademarks that appear on the Site belong to their respective owners. Use on the Site is nominative, for identification and editorial purposes only, and implies no affiliation with or endorsement by those owners.
9. Acceptable Use
You may not scrape, crawl, harvest, bulk-download, or systematically extract Content or Sentiment Data from the Site. You may not use our Content or data to train machine learning or AI models. You may not circumvent rate limits, access controls, or security measures. You may not use automated access other than good-faith search engine indexing. You may not republish, resell, or redistribute our datasets or substantial portions of the Site. You may not frame or mirror the Site. You may not misrepresent your affiliation with us. You may not interfere with the operation of the Site. You may not use the Site to violate any applicable law. You may not attempt any of the conduct described above.
10. User Content and Submissions
By submitting User Content to us, including through business feedback, contact messages, or other channels, you grant the Company a non-exclusive, perpetual, royalty-free, worldwide license to store, review, reproduce, and, at our discretion, publish or reference the submission in connection with the Site. You represent that you have the rights to what you submit and that it is not confidential.
We may remove or decline any submission at any time. Submitting ideas or suggestions does not create any obligation for us to use them, and we may use them without compensation or attribution.
11. Copyright Complaints
If you believe Content on the Site infringes your copyright, send a notice through the contact page or by mail to our principal address. Your notice should include identification of the copyrighted work, the URL of the allegedly infringing material on the Site, your contact information, a good-faith statement that use is not authorized, a statement of accuracy under penalty of perjury, and a physical or electronic signature.
We will review and respond as required by the Digital Millennium Copyright Act, may remove material we believe infringes copyright, and may terminate access of repeat infringers.
12. Affiliate Links
Some links on the Site are affiliate links. We may earn a commission if you make a purchase through them, at no additional cost to you. Affiliate relationships never influence Sentiment Data, which is computed by the documented method regardless of any commercial relationship. Full details are on our Affiliate Disclosure page.
13. Third-Party Sites
Links to third-party websites are provided for convenience. We are not responsible for third-party content, terms of use, or privacy practices.
14. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect personal information.
15. Suspension and Termination
We may suspend, restrict, or terminate your access to the Site if you violate these Terms or harm the Site, with or without notice. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, survive termination.
16. Disclaimers
The Site, Content, and Sentiment Data are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, and uninterrupted or error-free operation.
17. Limitation of Liability
To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising from your use of the Site. Our aggregate liability for all claims relating to the Site will not exceed one hundred US dollars.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the greatest extent permitted by law, and you may have additional rights.
18. Indemnification
You will indemnify and hold the Company, its members, managers, and agents harmless from any claims, damages, losses, and reasonable attorneys' fees arising from your User Content, your misuse of the Site, or your violation of these Terms or applicable law.
19. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law rules. Before filing any legal claim, both parties agree to attempt informal resolution for 30 days starting from written notice sent through the contact page.
Exclusive jurisdiction and venue for disputes lie in the state and federal courts located in Wyoming, and each party consents to personal jurisdiction there. Either party may bring qualifying claims in small claims court.
20. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. These Terms, together with the Privacy Policy and other policies referenced here, are the entire agreement between you and the Company regarding the Site. We are not liable for delays or failures caused by events beyond our reasonable control. Section headings are for convenience only and do not affect interpretation.
21. Changes to Terms
We may revise these Terms by posting an updated version with a new date. Material changes may be highlighted on the Site. Continued use of the Site after changes are posted means you accept the revised Terms.
